Terms of Service

These Terms of Service (“Terms”) govern your use of the QwikTik website, web dashboard, mobile apps, and APIs (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who these Terms apply to

QwikTik provides booking-management software to service businesses. These Terms apply to two groups:

• Business accounts — owners and staff who sign up to manage bookings, services, customers, and invoices.
• Booking customers— people who book an appointment through a business’s QwikTik booking page.

2. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract to use the Service. You are responsible for safeguarding your password or sign-in credentials and for any activity under your account. Notify us immediately of any unauthorised access.

3. Acceptable use

You agree not to:

• Use the Service for unlawful purposes or to send unsolicited messages.
• Attempt to access accounts, data, or systems you do not own.
• Reverse-engineer, scrape, or otherwise abuse the Service or its APIs.
• Upload content that infringes intellectual-property rights, violates privacy, or is harmful or harassing.
• Interfere with the security or availability of the Service.

4. Your content and your customers’ data

Business accounts retain ownership of the content they upload (service descriptions, customer records, intake answers, invoices) and grant QwikTik the rights necessary to operate the Service on their behalf. Business accounts are the data controllers for their customers’ personal information; QwikTik is the data processor.

You are responsible for ensuring you have the right to provide any customer information to QwikTik and for complying with applicable privacy laws when you do so.

5. Plans, billing, and refunds

Some QwikTik features are free, and others may require a paid plan. Paid plans are billed in advance on a recurring basis. Pricing, billing cycle, and refund policy for any paid plan are published on the pricing page and shown at checkout.

Taxes (GST, VAT, sales tax) where applicable are charged in addition to the listed price.

6. Third-party services

The Service integrates with third-party providers (payment processors, email delivery, calendar systems, OAuth providers such as Google). Use of those providers is governed by their own terms; we are not responsible for their actions or outages.

7. Intellectual property

QwikTik and its licensors own the Service, including its software, branding, designs, and documentation. We grant you a limited, non-exclusive, revocable license to use the Service in accordance with these Terms. You may not copy, modify, or distribute any part of the Service except as permitted.

8. Suspension and termination

We may suspend or terminate an account that violates these Terms, fails to pay for a paid plan, or poses a security or legal risk. You may close your account at any time from the dashboard. On termination, we may delete account data after a reasonable retention period, subject to legal record-keeping obligations.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or perfectly secure.

10. Limitation of liability

To the maximum extent permitted by law, QwikTik will not be liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim (or, if you have paid us nothing, the equivalent of US$50).

11. Indemnity

You agree to indemnify and hold QwikTik harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the dashboard or by email. Continued use of the Service after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which QwikTik is established, without regard to its conflict-of-laws rules. Disputes shall be brought in the courts of that jurisdiction.
